A temporary employee was using a torch to cut scrap. A track-hoe with a shear was working approximately 40 feet from the employee. The shear dropped a piece of scrap to the ground, striking a 6-foot long, 3 1/2" in diameter solid shaft. The shaft went airborne and hit the employee.
